Terms of Service
These Terms govern your use of Growth OS (the "Service"), provided by GetBerq LLC, a Wyoming limited liability company ("GetBerq", "we"). By creating an account or using the Service you agree to these Terms on behalf of yourself and the organization you represent.
1. The Service
Growth OS connects to Google advertising and analytics products you authorize, audits measurement and performance, and proposes changes. Changes are applied to your accounts only after an authorized user approves them in the Service.
2. Your accounts and approvals
- You must have authority to connect each Google account you connect and to approve changes to it.
- You are responsible for changes you approve, including their effect on spend and performance. Recommendations are suggestions, not guarantees of results.
- You are responsible for keeping your login credentials secure and for activity under your account.
3. Acceptable use
You will not use the Service to violate law or the policies of Google or any other platform, to access accounts you are not authorized to manage, to interfere with the Service's operation, or to reverse-engineer it except where law permits.
4. Third-party platforms
The Service relies on Google APIs. Your use of Google products remains subject to Google's terms. We are not responsible for changes, outages or limits imposed by third-party platforms.
5. Fees
The Service is currently offered free of charge during early access. Before any paid plan applies to you, we will tell you the price in advance and you will need to accept it; nothing is charged without that acceptance.
6. Data
You keep ownership of your data. You grant us the rights needed to process it to provide the Service, as described in our Privacy Policy. We may use aggregated, de-identified usage statistics that do not include Google user data to operate and improve the Service.
7. Availability and changes
We aim for the Service to be reliable but do not guarantee uninterrupted availability. We may change or discontinue features; we will give reasonable notice of material changes.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or to protect the Service or other users. On termination we delete your data as described in the Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETBERQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETBERQ WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR AD SPEND. GETBERQ'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 100.
11. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules.
